Coronavirus Stimulus Payments and Social Security Recipients

The new CARES Act was enacted on March 27, 2020.  Below we provide answers to some common questions about this new law.  At Koler Law Office we are continuing to stay on top of the latest developments and will continue to update you.

Will I receive a Stimulus payment even if I have not filed taxes?


Yes.  On April 1, 2020, the Treasury Department announced that Social Security recipients will automatically receive economic impact payments.  Even people currently receiving Social Security payments who have not filed tax returns for 2018 or 2019 will automatically receive their $1200.00 payment. Checks will be electronically deposited or mailed depending how you normally receive your payment.

How will the Stimulus payments affect my spouse or parent’s Medicaid eligibility?

The stimulus check will NOT effect eligibility for benefits even if its puts your account over the resource limit.  The $1,200.00 check will not count as an asset for 12 months.  The check may also be gifted without creating a penalty.  Please contact Koler Law Office to discuss gifting this checkWe are here to answer any of your questions.
